Court bars Kenya Medical Training College from admitting students for 2015/16 academic year

   The admission of students to the Kenya Medical Training College ( KMTC ) has been thrown into a limbo after two students obtained temporary orders at a High Court in Nakuru barring new admissions.
   David Mburu Mwangi and Anthony Thuita Mwai moved to court following a decision by the medical college to disown students admitted by the Kenya Universities and Colleges Central Placement Services (KUCCPS).
    Justice Moureen Odero issued temporary orders on Wednesday restraining KMTC from admitting students selected by the institution for the 2015-16 academic year pending the hearing and determination of the case.

   “Pending hearing and determination of the application herein inter partes this Honourable Court be pleased to issue orders of injunction restraining the 1st Respondent ( KMTC ) by itself, agents, servants, employees and/or any person exercising authority from admitting the selected students as enlisted in the 1st Respondent website”, read the ruling.
  
    According to the two petitioners, they applied and were admitted to KMTC following a newspaper advertisement on April 15 but were shocked to learn that the medical college won’t admit students selected by KUCCPS.
KMTC through an advertisement in August 1 said that the board did not recognize students admitted through KUCCPS throwing several students into a state of despair.
“I and my co-Applicants were taken aback by the said advert since the 1st Respondent had by the aforementioned advertisement recognized that the body mandated for placement of “Government sponsored students” was Kenya Universities and Colleges Central Placement Services and had even further admitted students, last academic year,” Mburu noted.

The Board also affirmed that the selection of new students to KMTC is a mandate of the college academic board and only students selected by KMTC will be admitted to the college.
Mburu, who hails from Ol Kalou in Nyandarua County, in the petition, said that he applied for admission and paid Sh1000 through Mpesa to the KUCCPS.
He maintained that the selection process by KUCCPS met all legal threshold under relevant laws and regulation and added that KMTC had acted arbitrarily without giving due regard to fair administration process.
He also added that KMTC had contravened Section 56 of the Universities Act and also provision of Technical and Vocational Education and Training Act 2013.

   The petitioners want the court to order KMTC to admit students placed by KUCCPS and make a declaration that KMTC violated the right to fair administrative action.

They have also asked the court to declare illegal and void, the move by KMTC to decline to admit government sponsored students placed by KUCCPS.

   The case has been certified agent and is set for hearing on September 2.

2015/2016 Inter-Institution Transfer
The 2015/2016 Placement Cycle for Government-sponsored students to Universities and Colleges has concluded. Applicants who have been successfully placed and wish to apply for inter-institution transfer should note the following:
The portal for inter-institution application will be open till 30th September 2015.
Application for transfer is based on medical or socio-economic grounds.
One must have met the cutoff for the program they wish to transfer to.
The procedure is as follows:
1. Log in with your index number, KSCE year and birth certificate number.
2. Navigate to the Inter-institution transfer link under Applications.
3. Fill in the online inter-institution transfer form.
4. Download and print the completed form.
5. Have the form endorsed both from the institution where you have been placed and the one which you wish to transfer to.
6. Submit the forms to the Placement Service for final approval and validation.
